Unauthorised possession of company's quarters by the workman is a gross misconduct justifying removal from service

A. COMENSATION IN LIEU OF REINSTATEMENT - Labour Court held the termination of services of the workman not proper awarding reinstatement with all back wages benefits and continuity of service - Management challenged award in writ petition - Writ Court considering the fact that workman has already attained the age of superannuation, modified the award to lump sum compensation of Rs.2 Lakhs to be paid in six weeks - Workman and Management both challenged judgment of writ court by filing L.P.As. - Held, contention of management is that the finding of the Writ Court is erroneous since the Labour Court has held the enquiry fair and proper, awarding reinstatement to the workman is not proper - Award has also been upheld by the Writ Court, hence award was fit to be set aside, instead of modifying it to lumpsum compensation - Workman was gainfully employed and compensation of Rs.2 Lakhs was unwarranted - Contention of workman is that he is entitled for an amount of about Rs.30 Lakhs - Asking t... subscribe to read more..
